Injunctions, Hallucinations, and the CIPA
Please join us Monday, September 1, 2026, at noon, as we discuss three topics in intellectual property and privacy law. First, we will discuss the patent case Wonderland Switzerland AG v. Evenflo Co., 162 F.4th 1346 (Fed. Cir. 2025). The Court of Appeals for the Federal Circuit reversed certain infringement findings, reversed a permanent injunction, and ordered a new trial on the willfulness that did not exclude defendants’ “Dracula email chain”.
Next, we will discuss the USPTO’s first AI discipline order, In re Brian E. Mitchell, Proceeding No. D2026-16. Mitchell included hallucinated citations to the intrinsic record in a claim construction chart. The OED found violations of 37 C.F.R §§ 11.101, 11.103, 11.804(c), and 11.804(d).
Finally, we will round-up several recent CIPA privacy developments that may signal a trend in defendants’ favor.
Chris Dugger, of counsel to SoCal IP, will lead the discussion.
