For our weekly SoCal IP Institute meeting on Monday, June 24th, 2019, we are pleased to welcome our guest speaker Thomas Neches.
Thomas Neches, CPA/ABV/CFF, CVA, CFE, shares his thirty-four years of trial testimony experience in a discussion of a patent infringement case in which he recently testified as plaintiff’s damages expert in USDC Santa Ana. The patented item was a lamp holder sold as a component of photo studio kits targeted to non-professional photographers. Issues covered in the course regarding Mr. Neches’ trial testimony include: (1) determining actual sales, but-for sales and lost sales of the kits; (2) allocating lost sales to functional units containing the patented lamp holder; (3) determining marginal lost profit attributable to lost sales of functional units, and (4) responding to defendant’s expert’s criticisms of Mr. Neches’ methodologies and assumptions. Spoiler alert: the jury awarded the exact amount of lost profits determined by Mr. Neches.
