For our weekly SoCal IP Institute meeting on Monday, March 16th, 2020 we will discuss the following indictment:
US v. Huawei (E.D.N.Y. 2020) (available here)
On February 13, 2020 a superseding indictment was returned from the Eastern District of New York. The indictment charges Huawei and several subsidiary companies with conspiracy to violate the Racketeer Influenced and Corrupt Organizations Act (RICO). The theories asserted in the indictment stem from theft of IP including trade secret misappropriation, copyright infringement, and violating various technology related agreements. Of note, the indictment accuses Huawei of lying to the FBI and giving bonuses to employees that committed intellectual property theft.
