For our weekly SoCal IP Institute meeting on Monday, September 14th, 2020 we will discuss the following cases:

Corbello v. Valli (9th Cir. 2020) (Case Here)

The 9th Circuit held that a state right of publicity claim was preempted by the copyright act.  In the underlying case, acclaimed rapper 50 cent sued another rapper for using 50 cent’s voice in a remix of a recording. The 9th circuit ruled the claim was “a thinly disguised effort to exert control over an unauthorized work”.

Smash Franchise Partners, LLC v. Kanda Holdings, Inc (Del. Ch. 2020) (Case Here)

A Delaware court denied plaintiff’s preliminary injunction motion related to claims for trade-secret misappropriation. Specifically, the court looked to the fact plaintiff had held meetings via zoom in which confidential information was discussed and disseminated for the public to see.
