Our weekly SoCal IP Institute meeting on Monday, July 13, 2015 will be a discussion of the following cases:

UVeritech, Inc. v. Amax Lighting, Inc., TTAB Cancellation No. 92057088, June 29, 2015 (available here).  In this TTAB cancellation proceeding, the U.S. seller petitioned to cancel the foreign manufacturer’s trademark. The TTAB ruled in favor of the U.S. seller and canceled the registered trademark on the basis that the foreign manufacturer was not the owner of the mark.

Gaymar Industries, Inc. v. Cincinnati Sub-Zero Products, Inc., (Fed. Cir. June 25, 2015) (available here).  Gaymar sued defendant Cincinnati Sub-Zero Products alleging infringing of Gaymar’s patent related to a patient controlled temperature system. CSZ appealed the district court’s denial of attorney fees. The Federal Circuit affirmed the district court’s ruling regarding the objectively baseless standard, but reversed the district court’s ruling regarding the exceptional case standard.
