For our weekly SoCal IP Institute meeting on Monday, June 13, 2016, we will discuss the following cases:
In re: Aqua Products, Inc. (Fed. Cir. May 25, 2016) (available here). Aqua Products, Inc. appealed a final written decision of the Patent Trial and Appeal Board in an inter partes review, where the Board denied their motion to substitute certain claims of a patent regarding automated swimming pool cleaners. The Federal Circuit held that the Board did not abuse its discretion by denying appellant’s motion to amend.
International Information Systems Security Certification Consortium, Inc. v. Security University, LLC (2d. Cir. May 18, 2016) (available here). Plaintiff appealed the District Court’s decision in a trademark action related to the mark CISSP, which indicates a person who has met certain requirements and standards of competency in the information security field. Plaintiff had claimed violations of the Lanham Act, including infringement, false designation of origin and false advertising, and trademark dilution. The Second Circuit Court of Appeals reversed the lower court’s grant of summary judgment to defendants on the infringement, false designation of origin and false advertising, and unfair competition claims; and affirmed the grant of summary judgment on the trademark dilution claims.
