We will be discussing the America Invents Act (Summary Attached) which passed the U.S. Senate on March 8.  We  will consider the AIA’s revisions to the Patent Act, the likelihood of its passage in the U.S. House of Representatives and its potential effects on the process of obtaining and enforcing patent rights.

If it is also passed by the House, the AIA would change the U.S. patent process to a first-to-file system.  It would also eliminate interferences, add a derivation claim process in the USPTO, add a short post-grant review process in the USPTO, allow any third party to submit a publication for consideration by an examiner during prosecution and make various other changes.
