For our weekly SoCal IP Institute meeting on Monday, April 16, 2018, we will discuss:
In re Brandt, (CAFC March 27, 2018) (available here). Brandt applied for a patent relating to boards for roof making. The assigned patent examiner and PTAB both found the invention obvious in light of prior art disclosing a range very similar to, but not identical to the range disclosed in the Brandt specification. The CAFC affirmed, finding the difference between the claimed range and the prior art range virtually negligible.
Arista Networks v. Cisco Systems , (CAFC March 28, 2018) (available here). Arista filed an IPR against Cisco’s patent. The PTAB found Arista failed to show certain claims were unpatentable. The CAFC remanded, finding the Board did not adequately explain its reasoning.
