For our weekly SoCal IP Institute meeting on Monday, February 25th , 2019, we will discuss the following cases:

Boost Beauty v. Woo Signatures (CD Cal February 11, 2019)(Available Here) Plaintiff and defendant both produced cosmetic products. Defendant used Plaintiff’s mark in an ad campaign by purchasing AdWords containing the mark. Plaintiff sued defendant for among other things, counterfeiting. The court held that using plaintiff’s trademark in an ad campaign did not amount to counterfeiting.

Boffoli v. Atemis  (WD Wash. February 5, 2019) (Available  Here) An Artist found one of his works posted to Facebook without his permission. Plaintiff sued in District court asking for $150,000 in damages and obtained a default judgment. The court adjusted the award down to $15,000, reasoning that was the “just” amount.
