For our weekly SoCal IP Institute meeting on Monday, June 3rd, 2019, we will discuss the following cases:
AVX Corp. v. Presidio Components, Inc, (CAFC May 13th 2019) (Available Here). Presidio and AVX both produce ceramic capacitor components. AVX petitioned the USPTO for IPR review of several patents owned by Presidio. the Patent Office granted the petition, and found several claims in Presidio’s patents invalid. On Appeal, Presidio argued that AVX did not have standing required by Article III of the constitution to appeal, the federal circuit agreed.
Thermolife Int’l, LLC v. GNC Corp (CAFC May 1, 2019) (Available Here) Thermolife licensed several patents from Stanford university and sued various companies for patent infringement. Two defendants Hi-Tech Pharmaceutical Inc. and Vital Pharmaceuticals prevailed at a bench trial and motioned for attorney’s fees. The district court granted the motion. On appeal, Thermolife argued that the determination of the case being “exceptional” was erroneous, the federal circuit disagreed and affirmed the district court.
