For our weekly SoCal IP Institute meeting on Monday, January 6th, 2019, we will discuss the following cases:

Blackbird Tech LLC v. Health In Motion LLC. (Fed Cir. 2019) (available here)

Blackbird sued Health In Motion in the U.S. District Court of Delaware, later transferring the case to the Central District of California for infringement of U.S. Patent No. 6,705,976. More than nineteen months of litigation ensued that resulted in Blackbird voluntarily dismissing the suit with prejudice. Appellee was granted attorney’s fees of $363,243.80 the federal circuit affirmed.

After a jury found defendant had willfully infringed, the court granted plaintiff’s motion to double the jury’s award of patent damages because of defendant’s lack of good faith, copying, size, and litigation conduct.
