For our weekly SoCal IP Institute meeting on Monday, May 14, 2018, we will discuss:

Andre Young v. Draion M. Burch DO, (TTAB May 3, 2017) (available here). Applicant registered the mark DR. DRAI for entertainment services. Andre Young (Aka Dr. Dre) filed an opposition against both marks alleging (1) likelihood of confusion (2) false suggestion of a connection and (3) dilution. The TTAB dismissed the opposition holding “[a]lthough Opposer has established that his name Dr. Dre is of sufficient fame or reputation, Opposer has failed to show that a connection would be presumed in the mind of the consuming public when Applicant’s DR. DRAI marks are used in connection with its applied-for goods and services.”
