Claim Construction and Prosecution Disclaimers

Please join us on Monday, November 3, 2025, at noon for a discussion of two recent decisions made by the U.S. Court of Appeals for the Federal Circuit.

In Barrette Outdoor Living, Inc. v. Fortress Iron, LP, No. 24-1231 (Fed. Cir. 2025), the court affirmed a finding of non-infringement, holding Barrette had disclaimed a limitation during a related continuation application’s prosecution and finding no invalidity for indefiniteness.

In Aortic Innovations, LLC v. Edwards Lifesciences Corporation, No. 24-1145 (Fed. Cir. 2025), the court affirmed the district court’s claim construction and a finding of non-infringement for three of Aortic’s patents, dismissed Aortic’s fourth asserted patent due to claim cancellation, and rejected Aortic’s estoppel argument.

Jonathan Gutierrez, associate at SoCal IP, will lead the discussion.
