Expletives and SAD Schemes

Please join us Monday, September 8, 2025, at noon where we will discuss the recent decision made by the U.S. Court of Appeals for the Federal Circuit in  In re Brunetti, No. 2023-1539 (Fed. Cir. Aug. 26, 2025) where the court reversed the TTAB’s decision due to a lack of clear guidance on when widely used words can serve as source identifiers, and a decision made by the District Court for the Northern District of Illinois in Eicher Motors Limited v. The Partnerships and Unincorporated Associations Identified on Schedule “A”, No. 25-cv-02937 (N.D. Ill. Aug. 8, 2025), where the court dismantled the Schedule A Defendent (“SAD”) scheme and denied the plaintiff’s ex parte Temporary Restraining Order and prejudgment asset restraint, explaining that the hallmarks of the SAD model does not comport with the Federal Rules or serve the public interest.

Jonathan Gutierrez, associate at SoCal IP, will lead the discussion.
