For our weekly SoCal IP Institute meeting on Monday, September 16th, 2019, we will discuss the following cases:
Intellectual Ventures v. Capital One Bank (CAFC 2019) (Here)
Intellectual Ventures amassed a massive patent portfolio and sued Capital One for patent infringement, Capital One counterclaimed asserting antitrust claims against Intellectual Ventures. The district court found Capital One did not infringe IV’s patents, but also gave a judgment against Capital One’s antitrust claims.
hiQ Labs, Inc. v. LinkedIn Corp (9th Cir. 2019) (Here)
HiQ Labs is a business that scrapes publicly available data from LinkedIn. LinkedIn tried to stop them by suing and invoking multiple causes of action including copyright infringement, portions of the Computer Fraud and Abuse Act, the DMCA, and even the California Penal Code. The district court disagreed with LinkedIn’s arguments and granted a preliminary injunction in favor or hiQ Labs.
