For our weekly SoCal IP Institute meeting on Monday, Nov. 7, 2016, we will discuss the following:
AMDOCS (ISRAEL) LIMITED v. OPENET TELECOM, INC., OPENET TELECOM LTD. (Fed Cir. Nov. 1, 2016) (available here). In a 61 page opinion, a split federal circuit holds that 4 Amdocs patents were erroneously found ineligible under Alice. Judge Plager authored the opinion and he was joined by Judge Newman and Judge Reyna authored a long dissent. This case follows similar precedent in DDR Holdings, Enfish, Bascom Global and McRO by focusing on a patent claim’s specification as being a consideration when determining patent eligibility versus only the claims.
