For our weekly SoCal IP Institute meeting on Monday, September 21, 2020 we will discuss the following cases:
Corbello v. Valli (9th Cir. 2020) (Case Here)
The 9th circuit denied copyright protection to an assertion of fact. Said the court “It is [a] feature of copyright law, not a bug or anomaly, that an author who deals in fact rather than fiction receives incomplete copyright protection for the results of his labor.”
Profade Apparel LLC v. Road Runner Sports (S.D Cal 2020) (Case Here)
Road Runner ordered socks from Profade, but soon after stopped ordering them. Profade sued under the DTSA alleging trade secret misappropriation. The Southern District judge dismissed holding Profade had failed to make a claim for trade secret misappropriation.
We will also discuss some statistics regarding the PTAB
All are invited to attend. Due to the Covid-19 situation the meeting will be conducted electronically via zoom. Join us by using this link at 12:00pm PT. This activity is approved for 1 hour of MCLE credit. If you will be joining us, please RSVP to Elisha Manzur by 9 am Monday morning.
